BOOST DYNAMIC TUNING — FLEX / MAGIC MOTORSPORTS LOANER CABLE AGREEMENT

This Agreement (“Contract”) is made between:

Lender: Trenten Smith d/b/a Boost Dynamic Tuning (“BDT”), located at 17 Hunter Road, Hilton Head Island, SC 29926
Borrower: _____________________________________________ (“Customer”)
Date: ____________________

1. Purpose of Agreement

Customer is temporarily receiving a FLEX / Magic Motorsports loaner cable (“Cable”) from BDT solely to flash or load an ECU/TCU calibration.
Ownership of the Cable remains with BDT at all times.

2. Security Deposit

Customer has paid a refundable deposit of $500 USD to BDT as security for the safe and timely return of the Cable.

• The deposit is not a purchase.

• A refund will be issued only after BDT receives the Cable in full working condition within the time limit stated below.

3. Return Requirement

Customer agrees to:

• Ship the Cable back to BDT within seven (7) business days of delivery, using a trackable and insured shipping method.

• Return it in the same functional and physical condition as received.

Tracking number must be emailed to boostdynamictuning@gmail.com immediately upon shipment.

4. Failure to Return or Damage

If the Customer:

• Fails to return the Cable within 7 business days, OR

• Returns a damaged, altered, or non-functional Cable, OR

• Fails to provide valid tracking information proving shipment within 7 business days,

then:

1. The $500 deposit is forfeited immediately; and

2. Customer agrees to pay an additional $2,500 USD to cover full replacement, downtime, and lost sales ($3,000 total value); and

3. Customer is responsible for all attorney fees, court costs, collection expenses, travel expenses, and lost business revenue resulting from breach of this Contract.

5. Governing Law & Jurisdiction

This Agreement is governed by the laws of the State of South Carolina.
Customer expressly consents that any dispute, claim, or enforcement action shall be brought exclusively in the courts of Beaufort County, South Carolina, and waives any right to object to that venue.

6. Indemnification

Customer agrees to indemnify and hold harmless BDT, its owners, and affiliates from any damages, liabilities, or claims arising from misuse of the Cable or failure to comply with this Agreement.

7. Acknowledgment and Acceptance

By signing below or purchasing the Loaner Cable through BDT’s online storefront, Customer acknowledges that they have read, understood, and agree to be legally bound by this Agreement.
